Terms and conditions of Designfashionline.

1. General
These terms and conditions apply to all our offers and the contracts for sale concluded with us. Designfashionline aims itself mainly at customers in Europe. Variations on these terms are only allowed after approval in writing by Designfashionline, at which time the remaining stipulations remain in force.

2. Offers / contracts for sale
A contract for sale is set up by placing an order on the Designfashionline website. Confirmation of the order takes place in the form of an email. If you notice a wrongly ordered article you should contact us immediately (within 48 hours) so we can correct the mistake. Otherwise mistakes are for the financial risk of the buyer.
All offers from Designfashionline are without engagement and Designfashionline explicitly reserves the right to modify prices, especially when this is necessitated by (legal) directions.  will always let you know when an ordered article has made a change of price, and after that you are free to renounce the purchase.
A contract for sale is only concluded when Designfashionline accepts your order. Designfashionline reserves the right to reject orders or to request certain conditions for delivery, unless explicitely stated otherwise.
In case an order is not accepted, Designfashionline will inform you within 10 working days after receiving said order.

3. Prices
The prices listed by us are inclusive of 19% VAT and in Euro, but exclusive of shipping costs. Designfashionline reserves the right to modify prices without notice.

4. Payment
Wait with your payment until you receive a confirmation email (because of products that cannot be delivered).
Payment in Advance:
Payment should take place within 7 days after the email confirmation. If we have not received your payment within this period it is possible that the article(s) you ordered are not available anymore against the agreed price. You can then order again for the new price.
If we have not received payment within 7 days we will consider your order void.
Payment takes place by transferring the amount due to our bank account 4263638 to the attention of De Stijlmeesters te Hilversum.

5. Delivery
The Netherlands:
Orders are usually shipped within 14 days after receiving payment. When articles are in stock, shipment will take place within a few days.
Except for new orders of handcrafted products and specially made products according to clients personal desires. These orders will take approx. 3-4 weeks after ordering. 
Europe:

Designfashionline ships to Europe, USA, Canada, Australia, New Zealand and Japan. All other countries on request only.
Any time of delivery stated by Designfashionline shall be treated as an estimate only. Failure to deliver within the stated times does not entitle you to request for compensation.
In case an article is not in stock we will inform you.
In the exceptional case that an article is not available anymore, Designfashionline reserves the right to, at any time, offer the customer either free shipment of a comparable product in quality and price or to credit the buyer for the amount paid.
In case of a failure to deliver in due time you are expected to contact us.
If a delivery time of more than 30 days is exceeded both Designfashionline and the buyer have the possibility to dissolve the agreement in writing, after which both parties are exempted from their obligations towards each other and any already fulfilled payments will be restituted.

To prevent longer waiting times Designfashionline is entitled to making deliveries in multiple shipments. Extra costs with regards to this are paid by Designfashionline.

6. Returns
All articles can be exchanged or refunded within 8 days following receipt. Please return the article(s) together with your response form post-paid.
On the form, please state:
- Date of receipt
- Reason of returning the article
- If you prefer replacement or reduction
- The needed account information in case of refund (this will take place within 2 weeks)
Articles will not be accepted in next cases:
A) if clothing has been worn, washed and/or damaged
B) for hygienic reasons if it concerns goods as earrings, make-up, stockings, lingerie as panties, bodies, et cetera
C) you have tried to repair a defect yourself
D) you have not followed the guidelines in the manual and/or instructions of use
E) article is incomplete
F) if articles have been specially made/changed according to clients personal desires
7. Damaged or faulty articles
If you find an article damaged or faulty (or if we accidentally sent you something wrong), you have to contact us within 3 days after receipt.
Always check the articles after arrival. Despite of the complete checklist that has been followed, some imperfection can be missed while checking the quality of articles. Due to the fact that many of the products we sell are completely handcrafted, small alterations in model and/or colour may exist.
Please return the article together with your response form registered (please note that these costs will only be compensated by Designfashionline if it concerns an imperfection of the article as a result of manufacturing.

On the form, please state:
- Date of receipt
- Reason for returning the article
- If you would prefer a replacement or your money back
- The necessary account information for restitution of the amount paid (which will take place within 2 weeks)

8. Shipment/shipping costs
Shipment takes place at the risk of the seller. Method of shipment and packaging is for us to decide. Juridical time of delivery is the moment the goods leave our company.
Orders > € 250,--: no handling and shipping cost will be charged.
Orders < € 250,--:
The Netherlands:
Free shipping
Europa:
Handling and shipping costs: € 39,90
Other countries and States:
Handling and shipping costs: € 59,90
Upon checking out the shipping costs are clearly stated.
When the articles are shipped, the risk with regards to the articles are passed on to the buyer.

9. Privacy policy
We will never sell or otherwise share any customer information from our records to third parties without your explicite permission.
In our secure database we keep the following personal information:
- Name and address
- Email address
- Telephone number
- Order data
This data will only be used to personalize your shopping experience at Designfashionline and for internal purposes to processing your orders and to comply with any legal requirements.. You will only receive advertising from Designfashionline (our newsletter) if you have explicitely subscribed to this on the website.

10. Force Majeure
In the event that the Company is prevented from carrying out its obligations under a contract for sale as a result of any circumstance beyond its control, Designfashionline shall be relieved of its obligations and liabilities under such contract for sale for as long as such fulfillment is prevented. Designfashionline also reserves the right to cancel said contract for sale without legal intervention, by informing you of this in writing. In this case we shall not be held for compensation unless this would be deemed unacceptable given the circumstances. The remaining stipulations in these terms shall not be diminished in any way by this.

11. Liability
Designfashionline shall under no circumstances whatsoever be liable for any direct or indirect damage, unless we explicitely accept liability in these terms. In the event of damage caused by wilfully misconduct, gross negligence/faults by Designfashionline the company shall be liable. The customer accepts that Designfashionline shall not be held to any claims by third parties. The liability of Designfashionline shall at any time be limited to the invoiced value to which the claim relates or the maximum value that Designfashionline might have charged the customer. Limitation of the liability as stated in this article also refers to employees and other persons used by Designfashionline to carry out the contract for sale.

12. General
If Designfashionline has allowed deviations of these terms during a certain amount of time, implied or not, the fact still remains that Designfashionline has the right to demand direct and strict application of these terms.
You can never claim any right with regards to Designfashionline's flexible use of these terms and conditions.
If any provision of these terms and conditions is held to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provisions in question shall not be affected thereby. Please contact Designfashionline with regards to any business not mentioned in these terms.

13. Intellectual and industrial property rights
You shall respect all intellectual and exclusive industrial and commercial property rights that exist on articles sold by Designfashionline, fully and unconditionally.

14. Copyright and database rights
All content, such as text, graphics, logos, button icons, images and software, the compilation of all content and all software unsed included on the website is the property of Designfashionline.com or its subsidiaries, its affiliates or its content suppliers and is protected by Dutch, European Union and international copyright and database right laws.
You may not systematically extract and/or re-utilise parts of the contents of the website without Designfashionline.com's express written consent. You also may not create and/or publish your own database that features substantial (e.g. our prices and product listings) parts of this website without Designfashionline.com's express written consent.

15. Governing law
All rights, obligations, offers, orders, agreements and other stipulations in these terms and conditions are subject to Dutch law and shall be submitted to the exclusive jurisdiction of the courts of The Netherlands.
